The rules for this website and for any messages we send you. Short, because short is honest.
Agreement
By using chalkthis.io or opting into messages from us, you agree to these terms. They are between you and Joe Lissy, doing business as chalkthis., based in Sound Beach, New York 11789. If you do not agree, do not use the site or opt in — no hard feelings either way.
What this website is
An information page and a way to start a conversation. Nothing on it is an offer, a contract, a guarantee of results, or professional legal, financial, or tax advice. Prices are not published here, and nothing you read on this site binds either of us to anything.
SMS messaging program
If you tick the SMS box on our form, you are joining the chalkthis. messaging program. Here is exactly what that means.
- Program. chalkthis. sends conversational and service messages about the enquiry you submitted or the work we are doing for you: replies, scheduling, reminders, and document handoffs.
- How you join. By checking the unchecked, optional box on our web form and submitting it. The wording you agree to is: “I agree to receive text messages from chalkthis. about my inquiry. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase.”
- Message frequency. Varies by conversation. Expect roughly 2 to 6 messages per month, and more only while we are actively working on something together.
- Cost. Message and data rates may apply. We charge you nothing for messages; your carrier may.
- Opting out. Reply STOP to any message at any time. You will get one confirmation message and then nothing further. You can also email us and we will remove you by hand.
- Getting help. Reply HELP to any message, or email joe@chalkthis.ai.
- Consent is never a condition. You do not have to accept messages to get a quote, an audit, or our services.
- Carriers. Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and can vary by carrier and device.
- Your number. Tell us if your mobile number changes or is reassigned, so we stop messaging a stranger.
How we handle the data behind all of this, including the commitment that mobile information is never sold or shared with third parties for marketing, is in our Privacy Policy.
Email we send in reply to you is a normal business reply. Any email we send as part of a campaign carries an unsubscribe link that works on the first click, and we honour it immediately.
Client work
Any actual engagement is governed by a separate written agreement covering scope, price, timelines, and ownership. Those terms control if they ever conflict with these. Two things are true of every engagement we take: you own your accounts and your data, and nothing goes out under your name without your approval.
Acceptable use
Do not use this site to break the law, break the site, or misrepresent who you are. Specifically, no:
- Submitting someone else's contact details as if they were your own.
- Automated scraping, probing, or attempts to defeat rate limits or security controls.
- Uploading anything malicious, or using the form to transmit spam.
No guarantee of results
We build systems that reduce missed calls, answer reviews, speed up quotes, and reactivate old customers. We do not promise a specific increase in revenue, leads, ranking, or reviews, and you should be skeptical of anyone who does. Any figures we quote from your own business are measured, and we will show you how we measured them.
Intellectual property
The chalkthis. name, the site's design, and its written content are ours. The systems, documents, and configurations we build for a client are handled by that client's engagement agreement, which generally leaves the client owning the result and the accounts it runs in.
Disclaimer and limitation of liability
This site is provided “as is” without warranties of any kind, to the fullest extent the law allows. To the fullest extent permitted by law, our total liability arising out of your use of this site or our messaging programs is limited to one hundred US dollars, or the amount you paid us in the three months before the claim, whichever is greater. Nothing here limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute belongs in the state or federal courts sitting in Suffolk County, New York, and we each consent to that.
Changes
We can update these terms. The date at the top changes when we do. Continuing to use the site after a change means you accept the updated version. Material changes to the messaging program will be sent to program participants directly.
